What Revenue is Hiding in your "Filing Cabinets"?
Many Law Firms don't realize they have a potential gold mine in their filing cabinets of "dry Judgments?. A limited company may be insolvent but in many instances the Judgment also covers principals, or individuals who have moved and-are hiding their revenue sources and assets. New cases and Clients change priorities, while many Judgments are left with partial results, as there just isn't the time or resources to pursue further.
A judgement is valid for 10 years and can be renewed for another 10. A lot can happen to a person over a 10-year span. Many defendants go into hiding while they rebuild their life and finances. After a while they drop their guard and resurface. We handle Judgment collections for a lot of law firms and it is amazing how often we successively collect on old Judgments.
With IRS You have Nothing to Lose
In House Receivable Services, or IRS, provides contingency Judgment collections. Basically, if you don't get paid, we don't get paid. We have experienced skip tracers who can locate defendants and exigible assets, which is included in our contingency fee.
In some cases, we can get the Judgment paid in full. Sometimes a sizeable settlement may be the best solution. It all depends on the defendant's current situation. It is better to recover X% of something than 100% of nothing.
We also have an efficient legal department that can execute fast garnishees when required. If we locate a bank account, or receivable in the morning, we can have the garnishee served that afternoon. We do not cover legal costs but we get your approval before any costs are incurred.
In some instances, the defendant may be indigent at the present time. In the majority of cases like this, we will monitor the defendant's circumstances on a semi or annual basis. If the defendant's situation is hopeless, we will provide details and close the file.
